Throughout these Terms, the terms “we”, “us” and “our” refer to Printora Limited. “You” and “your” refer to the person using our website or purchasing from us.
By visiting our website, using any part of it, or placing an order with us, you agree to these Terms of Service.
Nothing in these Terms affects your statutory rights as a consumer under UK law.
1. Our Online Store
Our website allows customers to browse and purchase clothing, personalised garments, printed products, accessories, digital products and other goods and services offered by Printora.
Our online store is hosted using Shopify, which provides the ecommerce platform we use to sell our products. Shopify is not the seller of products purchased from Printora and is not responsible for fulfilling your order.
You may not use our products, website or services for any unlawful or unauthorised purpose.
You must not transmit viruses, malware or other harmful code through our website.
2. Eligibility to Place an Order
By placing an order, you confirm that you are legally capable of entering into a contract.
If you are under 18, you should have permission from a parent or legal guardian before placing an order.
You must provide accurate and complete information when ordering, including your name, billing information, delivery address and contact details.
We are not responsible for delays or failed deliveries caused by incorrect information supplied by you.
3. Products
We make reasonable efforts to display our products, designs, colours, sizes and images as accurately as possible.
Colours may appear slightly different depending on your device, display settings, lighting and normal manufacturing variations.
Product images are intended to provide an accurate representation of the item, but minor differences may occur between mock-ups, photographs and the finished product.
Measurements and size guides are approximate and may vary slightly due to normal manufacturing tolerances. You are responsible for checking the relevant size information before ordering.
4. Personalised and Made-to-Order Products
Certain Printora products can be personalised or produced specifically to your requirements.
This may include names, numbers, text, photographs, artwork, logos or other customer-supplied information.
You are responsible for checking all personalised information carefully before submitting your order.
Once production has started, personalised or custom-made products generally cannot be changed or cancelled.
Under UK consumer law, the usual right to cancel an online purchase does not normally apply to goods that are made to your specifications or clearly personalised.
This does not affect your legal rights if the product is faulty, damaged, misdescribed or has been produced incorrectly by us.
5. Customer-Supplied Artwork and Content
Where you upload or provide an image, design, photograph, logo, text or other content, you confirm that you have the necessary rights or permission to use that material.
You must not provide content that infringes another person's copyright, trademark, privacy rights or other intellectual property rights.
You must not submit content that is illegal, defamatory, hateful or otherwise unlawful.
By providing content for the purpose of producing your order, you grant us permission to use that content solely as reasonably necessary to manufacture and fulfil your order.
6. Orders
Placing an order on our website constitutes an offer to purchase the selected products.
An order is not considered accepted until we have accepted and processed it.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
- A product is unavailable.
- There is an obvious pricing or description error.
- Payment cannot be authorised.
- We reasonably suspect fraud or misuse.
- Fulfilling the order would breach applicable law.
- Customer-supplied content cannot legally or practically be reproduced.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.
7. Prices and Payment
All prices are shown in pounds sterling unless otherwise stated.
The total price payable will be shown during checkout before you place your order. Delivery charges, where applicable, will also be displayed before payment.
We may change our prices at any time. Price changes will not affect orders that have already been accepted.
Payment must be made using one of the payment methods offered at checkout. Your order may be delayed or cancelled if payment cannot be authorised.
8. Pricing Errors
Although we take reasonable care to ensure prices are correct, errors may occasionally occur.
If an obvious pricing error is identified after you place an order, we may contact you and give you the option of proceeding at the correct price or cancelling the order.
We are not required to supply an item at a price that is clearly incorrect where the error would reasonably have been apparent.
9. Discounts and Promotional Offers
Discount codes, multi-buy promotions, sale prices and other promotional offers may be subject to additional conditions.
Unless otherwise stated:
- Discount codes cannot be exchanged for cash.
- Only one promotional code may be used per order.
- Discounts may be withdrawn or changed at any time before an order is placed.
- Promotions may exclude certain products.
- Discounts cannot normally be applied retrospectively to an order already completed.
10. Product Availability
All products are subject to availability.
Stock levels may change quickly, including where stock information is supplied by external suppliers.
On rare occasions, a product or particular size or colour may become unavailable after an order has been placed.
If this happens, we may contact you to offer an alternative, wait for replacement stock where appropriate, or issue a refund for the unavailable item.
11. Production and Processing Times
Some Printora products are printed, decorated or produced after an order is placed.
Personalised orders may require additional processing time before dispatch.
Any production or dispatch times shown on our website are estimates and are not guaranteed unless expressly stated otherwise.
We will make reasonable efforts to fulfil orders within the estimated timeframe.
12. Delivery
Orders are delivered to the address provided during checkout.
Estimated delivery times are shown on our website and in our Shipping Policy.
Delivery times are estimates and may be affected by events outside our reasonable control, including courier delays, severe weather, industrial action, transport disruption and peak seasonal demand.
We are responsible for the goods until they are delivered to you or to a person identified by you to receive them.
For consumer orders, risk in the goods passes to you when the goods are physically delivered to you or your nominated recipient.
If you ask a courier to leave a parcel in a specific safe place or with a nominated neighbour, responsibility may pass once delivery has been completed in accordance with those instructions.
13. Incorrect Delivery Information
You are responsible for providing the correct delivery address.
If an order is returned to us because an incorrect or incomplete address was provided, we may charge the reasonable cost of sending the parcel again.
If you notice an error in your delivery information, contact us as soon as possible at orders@printora.co.uk.
We cannot guarantee that an address can be changed after an order has entered production or been dispatched.
14. Returns and Cancellation Rights
For eligible non-personalised products purchased online, consumers generally have the right to cancel within 14 days of receiving the goods.
You must notify us within the applicable cancellation period if you wish to exercise this right.
After notifying us of a cancellation, the goods should be returned in accordance with our Refund Policy.
Returned products should be unused, unworn and in a suitable condition, except where handling was reasonably necessary to inspect the product.
You may be responsible for the cost of returning an unwanted item unless otherwise stated or unless the item is faulty, incorrect or misdescribed.
Please refer to our Refund Policy for full return instructions.
15. Personalised Product Returns
Products that are made to your specifications or clearly personalised are generally excluded from the statutory change-of-mind cancellation right.
This includes products personalised with customer-requested names, numbers, wording, images or other custom content.
Personalised products remain covered by your statutory rights where they are faulty, damaged, not as described or have been personalised incorrectly by us.
16. Sale and Discounted Products
Buying an item in a sale or using a promotional discount does not remove your statutory consumer rights.
Eligible non-personalised sale products purchased online may still qualify for statutory cancellation rights.
Products that are personalised or otherwise legally exempt from cancellation remain subject to those exemptions.
17. Faulty, Damaged or Incorrect Products
Please inspect your order when it arrives.
If an item is damaged, faulty, incorrect or has been produced incorrectly, contact us as soon as reasonably possible at orders@printora.co.uk.
Where possible, please provide:
- Your order number.
- A description of the issue.
- Clear photographs showing the problem.
We may offer an appropriate remedy in accordance with your legal rights, which may include repair, replacement or refund.
Asking customers to report problems promptly does not limit any statutory rights available under the Consumer Rights Act 2015 or other applicable law.
18. Refunds
Approved refunds will normally be returned to the original payment method.
The time taken for a refund to appear in your account may depend on your bank or payment provider.
Where legally required, we will process refunds within the applicable statutory timeframe.
Further information is available in our Refund Policy.
19. Digital Products
Where we sell digital content, downloads or digital design services, access may be provided electronically.
If you expressly request immediate access to digital content during the statutory cancellation period and acknowledge that your cancellation right may be lost once supply begins, your right to cancel may end once the digital content has been supplied in accordance with UK consumer law.
Digital products may not be redistributed, resold, shared or commercially exploited unless the relevant product licence expressly allows it.
20. Intellectual Property
Unless otherwise stated, the content of the Printora website, including its layout, branding, text, graphics, original artwork, photographs and other materials created by or for Printora, belongs to Printora Limited or is used under licence.
You may not reproduce, copy, distribute, sell or commercially exploit our content without permission.
Nothing in these Terms transfers ownership of any intellectual property rights to you.
Third-party names, trademarks, imagery or other rights remain the property of their respective owners.
21. User Comments, Reviews and Submissions
If you submit a review, comment, suggestion or other non-confidential content to us, you grant us permission to use, reproduce and display that content for legitimate business and promotional purposes.
You must not submit content that is unlawful, abusive, misleading, defamatory or infringes the rights of another person.
We may remove content from our website where we reasonably consider it inappropriate or unlawful.
22. Accuracy of Website Information
We aim to keep information on our website accurate and up to date.
However, occasional typographical errors, inaccuracies or omissions may occur, including in relation to product descriptions, prices, promotions, availability and delivery information.
We reserve the right to correct errors and update information where necessary.
23. Third-Party Links and Services
Our website may contain links to third-party websites or use services provided by third parties.
We are not responsible for the content, availability, privacy practices or terms of third-party websites.
You should review the relevant third party's terms and policies before using their services.
24. Prohibited Uses
You must not use our website:
- For unlawful purposes.
- To infringe intellectual property rights.
- To submit false or misleading information.
- To transmit malware or malicious code.
- To attempt unauthorised access to our systems.
- To collect information about other users unlawfully.
- To interfere with the security or operation of the website.
- To engage in fraudulent activity.
- To violate applicable laws or regulations.
We may restrict or terminate access to our website where we reasonably believe these Terms have been breached.
25. Website Availability
We do not guarantee that our website will always be available without interruption.
We may temporarily suspend or restrict access for maintenance, updates, security reasons or circumstances outside our reasonable control.
We may also change, update or discontinue features of the website where reasonably necessary.
26. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
In particular, nothing excludes liability for:
- Death or personal injury caused by negligence.
- Fraud or fraudulent misrepresentation.
- Any liability that cannot legally be excluded.
If you are a consumer, we are responsible for foreseeable losses caused by our breach of these Terms or failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
We are not responsible for business losses where products are purchased wholly for personal consumer use.
Nothing in this section affects your statutory consumer rights.
27. Events Outside Our Control
We will not be responsible for delays or failures caused by events outside our reasonable control.
This may include severe weather, fire, flood, epidemic, transport disruption, courier disruption, industrial disputes, telecommunications failures, supplier disruption or government action.
Where such an event affects an order, we will take reasonable steps to minimise the impact and keep you informed where appropriate.
28. Privacy and Personal Information
Your submission of personal information through our website is governed by our Privacy Policy.
We process personal information in accordance with applicable UK data protection law, including the UK GDPR and Data Protection Act 2018.
Please review our Privacy Policy for information about how we collect, use, store and protect personal data.
29. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as removed or limited to the minimum extent necessary.
The remaining provisions will continue in full force.
30. Waiver
If we do not immediately enforce a right under these Terms, this does not mean that we waive that right.
A waiver on one occasion does not constitute a waiver on any future occasion.
31. Entire Agreement
These Terms, together with our Refund Policy, Privacy Policy, Shipping Policy and any other policies expressly referred to on our website, form the agreement between you and Printora in relation to your use of the website and purchases from us.
32. Changes to These Terms
We may update these Terms from time to time.
The latest version will be published on our website with the updated date shown at the top.
Changes will not normally affect an order already accepted before the updated Terms came into effect.
33. Governing Law
These Terms and any contract between you and Printora Limited are governed by the laws of England and Wales.
If you are a consumer living elsewhere in the United Kingdom, you may also benefit from any mandatory legal protections that apply in the part of the UK where you live.
Nothing in these Terms prevents a consumer from relying on any mandatory legal rights regarding jurisdiction or consumer protection.
